Terms of Service

These Terms govern your use of RideByText (the "Service"), operated by RINO CONSULTING INC, 320 Roebling St, Brooklyn, NY 11211 ("we," "us," or "our"). By texting (929) 600-6427 or otherwise using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

RideByText lets you request rides by text message. You text a pickup and drop-off address, we check the addresses and reply with ride options and prices from Uber and Lyft, you reply to choose one, and we book that ride for you. You must be 18 or older and able to receive text messages.

2. SMS Terms

• Program name: RideByText.
• Program description: Transactional text messages about rides you request: address checks, price quotes, booking confirmations, driver and trip updates, payment setup links or phone numbers, receipts, and support replies. We do not send marketing messages.
• How you opt in: You opt in by texting your trip request to (929) 600-6427. We only message you in response to your requests and about rides you have booked.
• Message frequency: Varies based on how many rides you request, typically 3–8 messages per ride.
• Cost: Message and data rates may apply. Check with your mobile carrier for details.
• Opt out: Reply STOP at any time. You will receive one confirmation message and no further messages unless you text us again or reply START.
• Help: Reply HELP for help, or contact us using the details below.
• Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: See our Privacy Policy. We never share or sell your mobile number or SMS opt-in data to third parties or affiliates for marketing purposes.

3. Fees and payment

For each booked ride, you pay (a) the ride fare charged by the ride provider, and (b) a RideByText service fee of $2–$3. The total price is shown in the options we text you before you choose. Fares may change if the ride provider changes the trip (for example, added stops, tolls, wait time, or cancellation fees), and those changes are passed through to you. You provide your card once by entering it with your phone keypad; it is stored by our payment processor and charged for future rides you confirm. Our service fee is non-refundable once a ride is booked, except where required by law or where we made an error.

4. No affiliation with Uber or Lyft

RideByText is an independent service and is not affiliated with, endorsed by, or sponsored by Uber Technologies, Inc. or Lyft, Inc. Rides are provided by Uber, Lyft, and their independent drivers, and are subject to those companies' own terms and policies. We do not provide transportation, employ drivers, or control the vehicles, drivers, pickup times, or routes.

5. Your responsibilities

You agree to give accurate addresses, to be at the pickup point on time, to use the Service only for lawful purposes, and to use only payment cards you are authorized to use. We may refuse or end service for misuse, fraud, or unpaid charges.

6. Disclaimers

The Service is provided "as is" and "as available." Prices and availability come from third parties and can change. We do not guarantee that a ride will be available, that a driver will arrive at a particular time, or that text messages will be delivered without delay.

7. Limitation of liability

To the fullest extent allowed by law, RINO CONSULTING INC and its officers and employees are not liable for any indirect, incidental, special, or consequential damages, or for any acts or omissions of ride providers, drivers, or mobile carriers. Our total liability for any claim relating to the Service is limited to the service fees you paid us in the 3 months before the claim arose.

8. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Kings County, New York.

9. Changes

We may update these Terms by posting a new version here. Continuing to use the Service after a change means you accept the updated Terms.
